Terms of Service

OnlyCasts is a podcast hosting service run by 7sixty3, LLC ("OnlyCasts", "we", "us"). These terms are the agreement between you and us when you create an account or use the service at onlycasts.com, including your dashboard, your show pages, your feeds and the files we host for you.

By creating an account or ticking the box on the sign up page you agree to these terms and to our Privacy Policy. If you do not agree, do not use OnlyCasts.

OnlyCasts is offered to people and businesses in the United States. You must have a United States billing address and a payment method issued in the United States.

You must be at least 13 years old to create an account. If you are under 18, you confirm that a parent or guardian has read and agreed to these terms for you. We do not knowingly allow anyone under 13 to use the service and we remove accounts we learn belong to someone under 13.

If you use OnlyCasts for a company or organization, you confirm that you can agree to these terms on its behalf.

You sign in with a link we send to your email address. Keep your email account secure, because anyone who can read your email can sign in as you. You are responsible for what happens under your account, including what anyone you give access to does.

Give us accurate information and keep it up to date. Tell us through the contact form if you think someone else has accessed your account.

OnlyCasts is sold as monthly plans. Each plan lists its price, the number of shows, the storage and the monthly downloads it includes. The current plans and prices are shown on our pricing page and in your account.

• Free trial. New accounts start with a 14 day free trial. If you do not cancel before the trial ends, the plan you chose starts and your payment method is charged.
• Renewal. Plans renew every month until you cancel. We charge the payment method on file at the start of each period.
• Add-ons and overage. Add-ons, such as an extra show slot, are charged monthly. Charges for storage or downloads above your plan apply only if you turn overage on, and never above the monthly limit you set.
• Price changes. If we change the price of your plan, we tell you before the change reaches your next renewal. Customers keep the price they signed up at until a change takes effect.
• Taxes. Prices do not include sales tax or similar taxes, which we add where the law requires.
• Refunds. Fees are not refundable, except where the law requires or where we say otherwise in writing.
• Failed payments. If a payment fails we try again and tell you. If it still fails, the plan ends and the steps in the next section apply.

You can cancel at any time from your account. A canceled plan stays active until the end of the period you have paid for.

After a plan ends:

• For 30 days your account is read only. You can sign in, look at your shows and request an export of your files, but you cannot publish new episodes.
• After those 30 days your feeds stop serving.
• About 60 days after the plan ended, your files are permanently removed.

You can restart a plan before the files are removed. If you delete your account yourself, you have 30 days to restore it before it is permanently deleted. Backups of removed files are overwritten on our normal backup schedule, so a copy may remain in a backup for a short time after removal.

You own the audio, video, artwork, text and other material you upload or import ("your content"). We do not claim ownership of it.

You give us a worldwide, non exclusive license to store, copy, process and deliver your content, to the extent needed to run the service for you. That includes writing metadata into your files, generating your feeds and show pages, serving episodes to listeners and apps, keeping backups, and making a requested export. The license lasts as long as your content is on OnlyCasts and for the short time it takes to remove it from backups.

You are responsible for your content. You confirm that you own it or have every right and permission needed to publish it, and that publishing it through OnlyCasts does not break any law or anyone's rights.

You may not use OnlyCasts to publish, store or send:

• anything you do not have the right to publish, including other people's music, recordings, artwork or text without permission;
• content that is unlawful, defamatory, harassing, or that threatens or incites violence;
• sexual content involving minors, or anything that exploits or endangers a child;
• malware, or anything meant to damage or gain unauthorized access to a system or account;
• content that impersonates another person or show in a way meant to mislead listeners.

You also may not try to get around plan limits, probe or attack the service, send automated requests that disrupt other customers, resell the service as your own hosting platform without our written agreement, or use it to send spam.

When you import a show from an existing feed, you confirm that you own the show or are authorized to move it. We may ask you to prove control of the feed, for example by entering a code sent to the feed's owner email address or by placing a short token in the feed. An imported show stays private until that check is done.

Importing copies the feed's public information and files into your account. You remain responsible for them as your content.

Each show has an address on onlycasts.com. Addresses are given first come first served and are not owned. A show's address may be changed only once every 30 days, and old addresses of a show keep redirecting for as long as the show exists.

We keep a list of reserved names and may refuse, change or take back an address that impersonates an established show or person, infringes a trademark, or was taken to hold or resell the name. If you believe an address on OnlyCasts conflicts with your name or show, use the name conflict form on the contact page.

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act. Our process, including how to send a notice or a counter notice, is on our DMCA page.

We may remove or disable access to content that is the subject of a valid notice. We end the accounts of customers who are repeat infringers, as described on that page.

OnlyCasts gives you download counts for your episodes. If you add anything of your own to your show, such as links to a mailing list, a survey or a store, you are responsible for how you collect and handle that information and for following the laws that apply to it.

We work to keep OnlyCasts available and your feeds serving, but we do not promise that the service will be uninterrupted or error free. We may change, add or remove features. If we remove a feature you use in a way that matters, we will tell you ahead of time where we reasonably can.

Keep your own copy of your original files. OnlyCasts is a hosting service and is not meant to be your only archive.

We may suspend or end your account, or remove content, if you break these terms, if we are legally required to, if a payment is not made, or if your use puts the service or other customers at risk. Where we can, we will tell you why and give you a chance to fix it first.

You may stop using OnlyCasts and delete your account at any time. Sections that by their nature should continue, such as ownership, the disclaimers, the limits on liability and the rules on disputes, continue after the account ends.

The service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not promise any number of listeners, downloads, rankings or earnings.

To the fullest extent the law allows, OnlyCasts, 7sixty3, LLC and the people who work for it are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost audience. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim arose.

Some places do not allow these limits, so they may not apply to you in full.

You will defend and cover us against claims, losses and costs (including reasonable legal fees) that come from your content, from your use of the service in breach of these terms, or from your breaking the law or someone else's rights.

These terms are governed by the laws of the State of Wyoming and applicable United States federal law, without regard to conflict of law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in the State of New York, and you and we consent to those courts' jurisdiction.

Before starting a formal claim, please contact us through the contact form and give us 30 days to try to resolve it.

We may update these terms. If a change is significant, we will tell you by email or in your account before it takes effect. The date at the top shows when these terms were last updated. If you keep using OnlyCasts after a change takes effect, you accept the updated terms.
